Recent research has indicated that the student housing sector is hot right now. This makes perfect sense as nearly £840m was invested into the development of student accommodation last year. Rents in the sector have gone up by roughly 4% across the UK and up to 5% in London in the same year. Occupancy rates are at an incredible 99% too, a potential driver behind the rise in rents.

In recent years, with the steady rise in the number of young people heading to university, student properties have seemed like an attractive investment. For a time, the market has remained buoyant. The demand for student housing however is not consistent across all parts of the country. Picking a location and expecting tenancy requests cannot be guaranteed.

The Housing Act calls for the mandatory licensing of houses in multiple occupation (HMOs). Most student accommodation falls within the HMO definition, however if the sheer size and scale of these developments in comparison to a 'student house' means it has to be treated, and managed, differently. To license large student accommodation in the same way off street properties are licensed would be a logistical nightmare and incredibly expensive!

Consequently, when developing the Housing Act 2004, the government agreed to "exempt" educational establishments from mandatory HMO licensing provided they signed up to a code of management practice, approved by the government.
